GENERAL TERMS OF USE

These Terms of Use (“Terms”) constitute a legally binding agreement between you and Highway delite, a company incorporated under the laws of India and having its registered office at No 12, Above Adya Super Market,1st Floor, Srirampura, 2nd Stage, Devaiahnahundi Main Road Mysore, Karnataka, 570023 (“Highway delite ”, “we”, “us”, or “our”), and govern your access to and use of the Highway delite platform, including the website, mobile application, and all related services, tools, content, and features made available thereon (collectively, the “Platform”).

By accessing, browsing, registering on, or using the Platform in any manner, you confirm that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy, Cookie Policy, and such other policies as may be notified by Highway delite from time to time (collectively, the “Policies”).

If you do not agree with these Terms or any of the Policies, you must immediately discontinue use of the Platform.

Highway delite reserves the right to modify or update these Terms and/or any Policies at any time. Any such modifications shall be effective upon posting on the Platform, and your continued use of the Platform after such posting shall constitute your acceptance of the modified Terms.

These Terms constitute an electronic record under the Information Technology Act, 2000 and rules thereunder, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. This electronic record is generated by a computer system and does not require any physical or digital signatures.

You are responsible for reviewing the Terms and Policies periodically to ensure you are aware of the most current rights and obligations applicable to you.

1. DEFINITIONS

  1. “Applicable Laws” means all laws, rules, regulations, ordinances, codes, and guidelines in force in India or in any jurisdiction from which the Platform is accessed or used, including those relating to consumer protection, electronic commerce, and data privacy.
  2. “Account” means the registered user account created by a Customer on the Platform, required to access certain features or make a Booking.
  3. “Booking” means a confirmed reservation or purchase made by a Customer through the Platform for any Product listed by a Merchant.
  4. “Content” means any text, images, videos, reviews, ratings, or other material uploaded, posted, transmitted, or otherwise made available by any Customer or Merchant on or through the Platform.
  5. “Customer” means any individual who accesses, browses, registers on, or uses the Platform, and includes any person who places a Booking for themselves or on behalf of another person.
  6. “Customer Data” means any information or content submitted by a Customer on the Platform, including personal details, payment information, preferences, and communications.
  7. “Force Majeure Event” means any event or circumstance beyond the reasonable control of a Party, including but not limited to natural disasters, pandemics, government restrictions, war, terrorism, civil unrest, or disruptions in communication or transport infrastructure.
  8. “Merchant” means a third-party provider offering Products via the Platform, including operators of experiences, events, tours, activities, workshops, or related services.
  9. “No-Show” means a failure by a Customer to appear or avail of a Service at the designated time and place without prior cancellation as per the Cancellation and Refund Policy.
  10. “Platform” means the digital platform operated by Highway delite, including its website, mobile application, and any associated digital interfaces, through which Customers can browse, book, and manage Products.
  11. “Policies” means the Privacy Policy, Cookie Policy, Cancellation and Refund Policy, and any other rules, guidelines, or policies notified by Highway delite on the Platform from time to time.
  12. “Service” means any activity, experience, event, tour, workshop, or other offering listed by a Merchant on the Platform and made available for Booking by a Customer, including any related features, inclusions, or add-ons described in the relevant listing.
  13. “User” means any person who accesses and registers by creating account to use the Platform to avail benefit of it, and also include unregistered users who access and use the Platform without making any Booking.
  14. “Voucher” means a digital or physical confirmation (including QR codes, receipts, or tickets) issued to a Customer upon completion of a Booking, which must be presented to avail of the Service.

2. ELIGIBILITY AND USE OF PLATFORM

  1. You must be at least 18 years of age and capable of entering into a legally binding agreement under Applicable Laws in order to register for an Account, make a Booking, or otherwise use the Platform.
  2. By using the Platform, you represent and warrant that:
    1. a) you meet the eligibility criteria set forth in these Terms;
    2. b) all information you provide as part of your registration and use of the Platform, including Customer Data, is true, accurate, complete, and current; and
    3. c) you shall maintain the security and confidentiality of your Account credentials and not share them with any third party.
  3. You shall not use the Platform:
    1. a) for any unlawful, fraudulent, or malicious activity, or in violation of any Applicable Laws, including but not limited to the Information Technology Act, 2000 and the rules made thereunder;
    2. b) to solicit, collect, misuse, or access without authorization, any Customer Data or personal information of other Users or Merchants;
    3. c) to circumvent or interfere with the Booking process, Voucher issuance, pricing, Platform ratings or review mechanisms, or to promote off-Platform transactions or services;
    4. d) to impersonate any person or entity, or misrepresent your identity, affiliation, or authority in connection with the Platform;
    5. e) to upload, publish, transmit, or distribute any Content that is defamatory, obscene, pornographic, invasive of privacy, harassing, hateful, discriminatory, harmful to minors, misleading, or otherwise prohibited under Applicable Laws, including Content that threatens the unity, integrity, defence, security or sovereignty of India, or is likely to incite the commission of a cognisable offence;
    6. f) to introduce or transmit any viruses, malware, worms, trojans, or other harmful code, or otherwise disrupt or interfere with the security, integrity, or functionality of the Platform;
    7. g) to engage in scraping, indexing, data mining, mirroring, framing, or any other form of unauthorized automated data collection from the Platform without Highway delite’s prior written consent;
    8. h) to reverse engineer, decompile, disassemble, or attempt to derive the source code of any portion of the Platform or its underlying systems;
    9. i) to commercialize, reproduce, copy, modify, adapt, or create derivative works based on any part of the Platform or Content, except as expressly permitted by Highway delite in writing;
    10. j) to interfere with or restrict the use of the Platform by other Users or Merchants, or to host, display, upload, modify, publish, store, update, or share any Content that infringes intellectual property rights or violates any legal duty owed to a third party.
  4. You may have the ability to upload, post, submit, or transmit reviews, comments, photos, videos, suggestions, or other content (“User Content”) to or through the Platform.
  5. By submitting any User Content, you represent and warrant that:
    1. a) you own or otherwise have the necessary rights and permissions to submit such User Content;
    2. b) the User Content does not infringe the rights of any third party, including intellectual property rights, privacy rights, or publicity rights;
    3. c) the User Content does not violate any Applicable Laws or Highway delite Policies; and
    4. d) the User Content is not defamatory, obscene, discriminatory, or otherwise harmful.
  6. You hereby grant Highway delite a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, sublicensable right and license to use, host, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from such User Content (in whole or in part), in any form and media, for the purposes of operating, promoting, and improving the Platform and its Services, including in marketing materials, testimonials, or product listings.
  7. Highway delite does not pre-screen or monitor all User Content but reserves the right (without obligation) to remove, restrict, or disable access to any User Content that it deems, in its sole discretion, to be unlawful, offensive, misleading, infringing, or in violation of these Terms.
  8. Highway delite shall not be responsible or liable for any loss or damage arising from any User Content posted, uploaded, or otherwise made available by Users or third parties through the Platform.
  9. In order to access certain features of the Platform, including making a Booking, submitting User Content, or managing your Customer Data, you may be required to create an Account by providing accurate and complete information as prompted during the registration process. You agree to maintain and promptly update such information to ensure its accuracy and completeness at all times. Highway delite reserves the right to reject, suspend, or terminate any Account that is found to be incomplete, inaccurate, duplicative, or used in violation of these Terms or any Policies.
  10. You agree and acknowledge that you are solely responsible for all activity that occurs through your Account, whether authorized or not. You shall immediately notify Highway delite of any unauthorized access or use of your Account or any breach of security.
  11. You agree not to use the Platform for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Platform, or interfere with any other User’s access or use of the Platform, including by using bots, crawlers, or other automated systems without express written consent of Highway delite.
  12. If you make a Booking or access the Platform on behalf of another person (e.g., a group, minor, or dependent), you represent that you are authorized to act on their behalf and that they accept these Terms as if they were a direct party.
  13. Highway delite reserves the right, in its sole discretion, to suspend, restrict, or terminate your access to the Platform or your Account at any time, without prior notice, for any reason including but not limited to violation of these Terms, misuse of the Platform, or breach of any Policies.
  14. By using the Platform, you consent to receive communications from Highway delite electronically, including emails, SMS, and notifications posted on the Platform.

3. BOOKINGS AND VOUCHERS

  1. All Bookings made through the Platform are subject to availability and confirmation by the relevant Merchant. Highway delite does not guarantee the availability of any Service until a Booking is successfully completed and confirmed.
  2. Upon successful completion of a Booking, you will receive a Voucher via email, SMS, or through your Account on the Platform. This Voucher serves as proof of your Booking and must be presented (either in digital or printed form) to the Merchant at the time of availing the Service.
  3. You are responsible for verifying the accuracy of the Booking details, including the date, time, location, number of participants, and any specific instructions issued by the Merchant. Highway delite shall not be liable for any errors or omissions in the Booking caused by your failure to review or confirm such details.
  4. The Voucher is valid only for the specific Service and time period mentioned therein and is non-transferable unless explicitly permitted in the Policies or by the Merchant.
  5. A No-Show may result in forfeiture of the Booking amount without any refund, in accordance with the Cancellation and Refund Policy applicable to the specific Service.
  6. Subject to the applicable Policies and the specific terms of the Merchant, you may request modifications to your Booking (including change of date, time, or number of participants). All such requests shall be subject to availability and may incur additional charges or conditions as determined by the Merchant.
  7. In rare cases, a Booking may remain in pending status if confirmation from the Merchant is delayed due to technical, operational, or availability-related reasons. In such cases, Highway delite shall notify you of the status and either confirm the Booking, offer an alternative, or initiate a refund in accordance with the Policies.
  8. Highway delite is a facilitator and not the provider of the Service. The Merchant remains solely responsible for the fulfilment, quality, and delivery of the Service, and any disputes relating to the Booking shall be resolved in accordance with Clause Customer Support, unless otherwise stated.

4. PRICING, PAYMENTS, AND TAXES

  1. The prices for each Service listed on the Platform are determined solely by the respective Merchant and are displayed in Indian Rupees (INR), unless otherwise specified. Highway delite does not control or guarantee the accuracy of any pricing or availability, which may be subject to change at the discretion of the Merchant.
  2. The price displayed at the time of Booking shall include only those items explicitly mentioned in the Service description. Any additional charges (such as equipment rentals, entry fees, transportation, meals, or gratuities) that are not listed in the Booking shall be payable separately, either at the time of Booking or directly to the Merchant, as applicable.
  3. All payments for Bookings made through the Platform shall be processed via secure third-party payment gateways authorized by Highway delite. By initiating a payment, you authorize Highway delite to charge the payment method linked to your Account for the full amount due, including applicable taxes and fees.
  4. A Booking shall be deemed complete only upon successful receipt of payment. You will receive a confirmation and Voucher once the payment has been processed, and the Booking has been accepted by the relevant Merchant.
  5. Prices listed on the Platform may be inclusive or exclusive of applicable taxes, depending on the Merchant’s listing and location. You agree to pay all applicable Goods and Services Tax (GST), duties, levies, or other similar charges imposed under Applicable Laws, whether included in the Booking amount or payable separately.
  6. If the Platform permits payments in currencies other than INR, conversion rates shall be determined by the payment gateway or your financial institution, and Highway delite shall not be responsible for any currency conversion fees, charges, or losses incurred.
  7. Highway delite is not a bank, payment institution, or financial services provider. All payment transactions are processed by independent third-party payment gateways, and Highway delite shall not be responsible for any delays, failures, or issues arising during the payment process, including any unauthorized transactions or technical disruptions.
  8. Invoices for the Booking amount may be issued directly by the Merchant to the Customer in accordance with Applicable Laws. Highway delite may, in certain cases, issue system-generated invoices on behalf of the Merchant solely as a facilitation measure, without assuming any responsibility or liability for the accuracy, legality, or tax treatment of such invoices.
  9. Highway delite may, from time to time, issue promotional codes, credits, or discounts that can be applied to eligible Bookings, subject to additional terms and conditions. Highway delite reserves the right to withdraw or modify such offers at its sole discretion and without prior notice.
  10. If you believe any charge has been made in error, you must contact us promptly at Highway delite will investigate and, if appropriate, coordinate with the relevant Merchant to resolve the issue in accordance with the applicable Policies.

5. CANCELLATION AND REFUND POLICY

  1. Cancellation by Customer:

    1. a) You may cancel a Booking by accessing your Account and following the cancellation policy of the relevant Merchant and/or the cancellation process specified therein.
    2. b) Each Service offered by a Merchant may have its own cancellation terms, including deadlines, refund eligibility, and cancellation fees, which shall be clearly indicated on the Booking page or communicated to you prior to confirmation.
    3. c) Cancellations made after the specified cut-off time or in violation of the Merchant's stated policy may result in partial refunds or no refund, as applicable.
    4. d) Some Services, including discounted or promotional offerings, may be marked as "non-refundable" at the time of Booking and shall not be eligible for cancellation or refund under any circumstances.
  2. Refund Eligibility and Deductions:

    1. a) Refunds for cancelled Bookings will be processed in accordance with the terms of the cancellation policy of the relevant Merchant and/or Highway delite’s Cancellation and Refund Policy.
    2. b) Refunds may be full or partial, depending on the time of cancellation, the type of Service, and subject to cancellation charges, processing fees, or penalties, if any.
    3. c) Refunds shall exclude any convenience fees, payment gateway charges, applicable taxes (if non-refundable), and other non-recoverable charges, unless otherwise stated in the Merchant’s policy.
    4. d) Where applicable, refunds may also be subject to deductions for perishable or limited-slot Services, or where third-party costs (such as entry tickets or permits) have already been incurred.
  3. Refund Processing and Timelines:

    1. a) Approved refunds shall be processed using the same payment method used for the original transaction.
    2. b) Depending on the payment method and banking channels involved, it may take up to 7–14 Business Days (or longer in exceptional cases) for the refunded amount to reflect in your account.
    3. c) Highway delite shall not be responsible for any delays caused by payment processors, banks, or third-party intermediaries.
    4. d) You will receive an email or SMS confirmation once your refund has been processed. It is your responsibility to verify receipt and follow up with your bank if required.
  4. Modifications and Rescheduling Requests:

    1. a) Any request for change in Booking details (including date, time, number of participants, or type of Service) must be made through the Platform or support channels well in advance and shall be subject to: i) the specific Merchant’s modification policy; ii) availability of alternate slots; and iii) payment of any additional charges applicable to the modified Booking.
    2. b) Highway delite does not guarantee that modifications will be accepted and shall not be liable for any refusal by the Merchant.
  5. No-Show by Customer:

    1. a) If you fail to appear at the time and place specified in your Booking, or are otherwise unable to avail of the Service without prior notice and cancellation, you shall be treated as a No-Show.
    2. b) In such cases, you shall not be entitled to any refund, rescheduling, or compensation unless the Merchant has specifically agreed otherwise or unless otherwise stated in the Cancellation and Refund Policy.
    3. c) Multiple No-Shows may result in suspension or termination of your Account, at the sole discretion of Highway delite.
  6. Cancellation or Modification by Merchant:

    1. a) In rare instances, a Merchant may cancel or modify a Booking due to unforeseen circumstances, including overbooking, operational issues, or weather-related disruptions.
    2. b) In such cases, Highway delite will make reasonable efforts to notify you at the earliest and will facilitate one of the following, at your option: i) a full refund of the Booking amount; or ii) rescheduling of the Service to another mutually acceptable time/date; or iii) exchange with a comparable Service (subject to availability and your acceptance).
    3. c) Highway delite shall not be liable for any expenses, loss of opportunity, or inconvenience arising from such cancellation or modification.
  7. Force Majeure Cancellations:

    1. a) Where a Service is cancelled or materially affected due to a Force Majeure Event, Highway delite and/or the Merchant shall be exempt from further obligations and liabilities.
    2. b) Refunds or alternate arrangements in such cases will be subject to the Merchant’s policy and the prevailing laws and may vary depending on the circumstances.
    3. c) Any claims relating to Force Majeure shall be made in good faith and with supporting documentation where applicable.
  8. Customer Support:

    1. a) All cancellation and refund requests must be submitted via the Platform interface or by contacting customer support at support@rzervit.com.
    2. b) Highway delite will record your request, review it in accordance with the Merchant’s policy and applicable law, and liaise with the Merchant to resolve the issue in a timely manner.
    3. c) While Highway delite endeavors to mediate disputes fairly, you acknowledge that final decision-making authority on refunds and cancellations for Services rests with the Merchant.
  9. In the event of any dispute, refund request, or grievance, you agree to cooperate with Highway delite and provide all relevant information, including Booking details, communications with the Merchant, payment proof, and any other materials necessary to investigate and resolve the issue.
  10. To the fullest extent permitted by Applicable Laws, you agree that your sole and exclusive remedy for any cancellation, refund, or No-Show issue shall be limited to the amount paid for the affected Booking, and that you shall not claim any indirect, consequential, or special damages from Highway delite or its affiliates.

6. CUSTOMER CONDUCT AND OBLIGATIONS

  1. General Conduct Requirements: You agree to use the Platform and Services solely for lawful purposes and in accordance with these Terms. In particular, you agree not to:

    1. a) engage in any activity that is fraudulent, harmful, threatening, abusive, defamatory, obscene, vulgar, or otherwise objectionable in the context of the Platform;
    2. b) misrepresent your identity or provide false or misleading information;
    3. c) use the Platform for commercial purposes unrelated to the intended use of the Platform, including advertising, solicitation, or promotion without express prior written consent from Highway delite;
    4. d) violate the intellectual property rights or proprietary rights of Highway delite, a Merchant, or any third party;
    5. e) access or attempt to access any part of the Platform without authorization or by any automated means not permitted by Highway delite;
    6. f) introduce any viruses, malware, or other harmful code to the Platform that may affect its security or functionality;
    7. g) use any data mining, scraping, or extraction tools or processes without express written authorization from Highway delite.
  2. Reviews and Feedback:

    1. a) You may submit reviews, ratings, and feedback in relation to Services you have availed. By doing so, you represent that such Content is honest, accurate, non-defamatory, and compliant with Applicable Laws.
    2. b) Highway delite reserves the right (but not the obligation) to review, moderate, or remove any Content posted by you that it deems inappropriate, misleading, or in violation of these Terms.
    3. c) Highway delite shall have a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, display, and publish any review or feedback you submit, for promotional, analytical, or operational purposes.
  3. Compliance with Service Instructions: You are responsible for complying with all safety guidelines, instructions, prerequisites, and terms set out in the Service listing or communicated by the Merchant. This includes but is not limited to:

    1. a) timely arrival at the designated location;
    2. b) carrying required documents or identification;
    3. c) adhering to health, fitness, or dress code requirements;
    4. d) following age or participation restrictions, where applicable.
  4. Prohibited Behaviour During Services: During participation in any Service, you agree not to:

    1. a) disrupt or interfere with other participants’ enjoyment of the Service;
    2. b) behave in a manner that endangers yourself or others;
    3. c) damage, misuse, or misappropriate any property belonging to the Merchant or third parties;
    4. d) violate any rules or instructions provided by the Merchant or applicable local authorities.
  5. You shall be liable for any damage, loss, or harm caused by your breach of these Terms, misconduct, or non-compliance with the instructions of the Merchant. Highway delite reserves the right to recover costs or restrict future access to the Platform in such cases.
  6. If you encounter any behavior or Content on the Platform that violates these Terms or appears to be fraudulent, harmful, or abusive, you are encouraged to report it promptly to Highway delite at [insert grievance redressal contact].

7. INTELLECTUAL PROPERTY RIGHTS

  1. All rights, title, and interest in and to the Platform, including its design, layout, software, code, interfaces, databases, text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and all other Content and materials therein (excluding Customer or Merchant Content), are the exclusive property of Highway delite or its licensors and are protected under Applicable Laws, including copyright, trademark, and other intellectual property laws.
  2. Subject to your compliance with these Terms, Highway delite grants you a limited, non-exclusive, non-transferable, revocable, and personal license to access and use the Platform solely for your personal and non-commercial use. This license does not grant you any right to: a) reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform for any commercial purposes; b) modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Platform; c) remove, alter, or obscure any proprietary notices on the Platform.
  3. The name “Highway delite,” its logo, and all related marks, graphics, and slogans are trademarks or service marks owned by Highway delite. You are not granted any right or license to use any of these marks without the express written permission of Highway delite.
  4. By submitting or uploading any Content to the Platform, including reviews, feedback, photos, or other contributions, you grant Highway delite a non-exclusive, worldwide, royalty-free, irrevocable, perpetual, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and exploit such Content in connection with the operation, marketing, or improvement of the Platform and Services.
  5. The Platform may include Content provided by third parties, including Merchants and other Users. Highway delite does not endorse, guarantee, or assume any responsibility for the accuracy, reliability, or legality of any such third-party Content. All rights in such Content belong to the respective third parties, and you may not use such Content except as permitted by law or with the permission of the rights holder.
  6. If you believe that any Content on the Platform infringes your copyright or other intellectual property rights, you may submit a takedown request to the Grievance Officer at support@rzervit.com with the following details:
    1. a) A description of the copyrighted work or material claimed to have been infringed;
    2. b) The exact URL or location of the allegedly infringing material on the Platform;
    3. c) Your name, address, email ID, and phone number;
    4. d) A statement that you believe, in good faith, that use of the material is not authorized by the copyright owner or law; and
    5. e) A declaration that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.
    Highway delite shall review such notices and take appropriate action in accordance with Applicable Laws. You also report any such infringement of intellectual property right of any third party as and when noticed by you by following the similar procedure as above.

8. PRIVACY AND DATA PROTECTION

  1. Highway delite values your privacy and handles all Customer Data in accordance with its Privacy Policy, which forms an integral part of these Terms.
  2. By using the Platform, you consent to the collection, use, storage, and disclosure of your personal information and other Customer Data as described in the Privacy Policy and as required for processing Bookings, providing Services, and facilitating Platform operations.
  3. Highway delite implements appropriate technical and organizational Security Measures to protect Customer Data against unauthorized access, disclosure, alteration, or destruction. However, you acknowledge that no system is completely secure, and Highway delite disclaims liability for any unauthorized access that is beyond its control.
  4. Highway delite shall not sell, rent, or share Customer Data with third parties for their marketing purposes without explicit consent, unless required to comply with Applicable Laws or a valid legal process.
  5. You are responsible for keeping your Account credentials confidential and for ensuring that your Customer Data is accurate and up to date.
  6. If you believe your privacy rights have been violated, or if you wish to exercise any rights under applicable data protection laws, you may contact our Data Protection Officer at compliance@rzervit.com.

9. MODERATION AND TAKEDOWN POLICY

  1. Highway delite reserves the right to monitor and moderate all Content uploaded or published on the Platform, including reviews, feedback, photographs, or Merchant listings.
  2. If Highway delite receives a written complaint or takedown request concerning any Content that is unlawful, infringing, offensive, or otherwise violative of these Terms or the IT Act, 2000, Highway delite shall act within the timelines prescribed under Applicable Laws to review and, if necessary, remove such Content.
  3. In cases where Content removal is contested, Highway delite may notify the concerned User or Merchant and allow a reasonable opportunity to respond, unless prohibited by law.
  4. Highway delite may also block access to Content or suspend services temporarily or permanently to Users or Merchants who repeatedly post or promote objectionable or infringing Content.

10. THIRD-PARTY SERVICES AND LINKS

  1. The Platform may include links or access to websites, mobile applications, platforms, tools, advertisements, or services that are owned, operated, or controlled by third parties and not by Highway delite (“Third-Party Services”). These may include, without limitation, payment gateways, mapping services, external booking platforms, promotional partners, or social media integrations.
  2. Access to or use of any Third-Party Services is provided solely as a convenience to you. Highway delite does not own, operate, control, or endorse any such Third-Party Services, nor does it make any representations or warranties regarding their accuracy, availability, reliability, security, legality, or suitability for any purpose.
  3. You acknowledge and agree that your access to or interaction with any Third-Party Services, including any services provided by Merchants, payment processors, or other external providers, is entirely at your own risk, and is governed exclusively by the terms of use, privacy policies, and other applicable agreements of such third parties. Highway delite shall not be liable for any act, omission, error, negligence, misconduct, or breach committed by such third parties.
  4. Any communications, transactions, bookings, or disputes between you and any third party, including Merchants, Users, or service providers, are solely between you and such third party. Highway delite shall not be responsible or liable for any claims, losses, damages, liabilities, or costs arising out of or relating to such dealings, whether contractual, tortious, statutory, or otherwise.
  5. If you are redirected outside the Platform, including to a Merchant’s own website or third-party portal for purposes such as payment processing, rescheduling, or additional terms, you acknowledge that Highway delite has no control over such redirection and expressly disclaims any liability in relation to the Content, functionality, availability, or security of such external sites.
  6. You further acknowledge that access to or use of such external websites, software, or tools may expose your device, system, or data to risks such as viruses, malware, data breaches, or other harmful components. To the fullest extent permitted under Applicable Laws, Highway delite shall not be liable for any loss, damage, corruption of data, or impairment to your hardware, software, or systems resulting from your interaction with such third-party services.

11. DISCLAIMERS AND LIMITATION OF LIABILITY

  1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIGHWAY DELITE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  2. Highway delite does not guarantee continuous, uninterrupted, or secure access to the Platform. Access may be subject to interruptions, delays, or errors due to system maintenance, upgrades, or Force Majeure Events. The Platform is provided on an "as is" and "as available" basis without any warranties of any kind.
  3. The Platform may display or facilitate access to Third-Party Services (including Merchant platforms, payment gateways, or external links). Highway delite does not warrant the safety, legality, accuracy, or reliability of such third-party Content or systems and shall not be liable for any loss, disruption, damage to systems, unauthorized access, or data breach caused by your use of or reliance on such third-party tools or links.
  4. All Services are performed solely by independent Merchants. Highway delite is not responsible for the fulfillment, conduct, or quality of any Service. You agree that any issues, deficiencies, or disputes relating to a Service must be raised directly with the relevant Merchant, and Highway delite's role is limited to facilitating communication and support. Highway delite does not operate or control the Services directly and is not responsible for the acts, omissions, or conduct of any Merchant, or for any injuries, losses, or damages resulting from your use of any such Services.
  5. Descriptions, photos, and availability of Services are provided by the Merchant and Highway delite does not warrant their accuracy. Service availability may be subject to change, limitations, or cancellation by the Merchant or local authorities.
  6. To the fullest extent permitted under Applicable Laws, Highway delite shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profit, goodwill, data, or opportunity, arising out of or in connection with: a) use or inability to use the Platform; b) errors or inaccuracies in third-party Content or Merchant listings; c) technical malfunctions or cybersecurity breaches linked to external systems; d) unauthorized access to or alteration of Customer Data; or e) any acts or omissions of Merchants or third parties.
  7. Highway delite’s total cumulative liability, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount paid by you for the affected Booking, and in no event shall exceed INR 5,000 (Indian Rupees Five Thousand only).

12. INDEMNITY

  1. To the maximum extent permitted under Applicable Laws, you agree to indemnify, defend, and hold harmless Highway delite, its affiliates, officers, directors, employees, agents, licensors, and service providers (collectively, the “Indemnified Parties”) from and against any and all losses, liabilities, claims, demands, actions, suits, damages, judgments, penalties, costs, and expenses (including reasonable attorneys’ fees and litigation costs) arising out of or in connection with: a) your breach or alleged breach of these Terms or any Policies; b) your access to, use, or misuse of the Platform or any Service; c) any violation of Applicable Laws, regulations, or third-party rights (including Intellectual Property Rights) by you or any person using your Account; d) any interaction, dispute, or transaction between you and any Merchant, User, or third party; or e) any Content, data, or information submitted, uploaded, or transmitted by you, including any claim that such material is defamatory, offensive, infringing, or otherwise unlawful.
  2. Highway delite reserves the right, at its sole discretion and at your expense, to assume the exclusive control and defense of any matter subject to indemnification by you. You agree to fully cooperate with Highway delite in asserting any available defenses and in the conduct of such defense.
  3. This indemnity obligation shall survive the termination or expiration of your use of the Platform and shall remain in full force and effect notwithstanding any other provision of these Terms.

13. TERMINATION AND SUSPENSION OF ACCOUNT

  1. You may terminate your Account at any time by submitting a request through the Platform or contacting customer support at support@rzervit.com. Upon termination, your access to the Platform and all Services shall cease, and any outstanding Bookings shall be handled in accordance with the applicable Policies.
  2. Highway delite reserves the right, at its sole discretion and without prior notice, to suspend, restrict, deactivate, or terminate your Account or access to the Platform if: a) you are found or suspected to be in breach of these Terms or any applicable Policies; b) you have engaged in fraudulent, abusive, harmful, or unlawful conduct; c) your actions or conduct pose a risk to other Users, Merchants, or the Platform's integrity or reputation; d) you have repeatedly failed to honor Bookings, misused the Platform, or committed No-Shows; or e) it is required under Applicable Laws, regulatory directions, or court orders.
  3. Upon termination of your Account: a) your right to use or access the Platform shall immediately cease; b) any pending or confirmed Bookings may be cancelled at the discretion of Highway delite or the relevant Merchant; c) you shall not be entitled to any refund or compensation for unused Services, unless specifically allowed under the applicable Cancellation and Refund Policy; d) Highway delite may retain Customer Data and transactional records for a reasonable period in accordance with its Privacy Policy and Applicable Laws.
  4. Termination of your Account shall not affect those provisions of these Terms which by their nature are intended to survive, including but not limited to Clauses relating to Intellectual Property, Indemnity, Limitation of Liability, Dispute Resolution, and Governing Law.
  5. If your Account was terminated or suspended in error or due to a resolvable issue, you may submit a written request for restoration. Highway delite may, at its sole discretion, reinstate your Account subject to verification and applicable conditions.

14. DISPUTE RESOLUTION AND GOVERNING LAW

  1. In the event of any concern, complaint, or dispute arising out of or relating to the use of the Platform, a Booking, or these Terms, you agree to first contact Highway delite at compliance@rzervit.com and attempt to resolve the issue amicably through informal discussions within fifteen (15) days from the date of such notice.
  2. If the Parties are unable to resolve the dispute amicably within the prescribed period, the dispute shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The arbitral tribunal shall consist of a sole arbitrator appointed mutually by the Parties. If the Parties fail to appoint a sole arbitrator within fifteen (15) days of referral, the arbitrator shall be appointed in accordance with the provisions of the Act. The seat and venue of arbitration shall be in Mysore India, and the arbitration proceedings shall be conducted in the English language. The arbitral award shall be final and binding on the Parties and may be enforced in any court of competent jurisdiction.
  3. These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Subject to Clause 13.2, the courts at Mysore, India, shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the use of the Platform.
  4. Notwithstanding the foregoing, Highway delite reserves the right to seek interim or injunctive relief in any court of competent jurisdiction to protect its Intellectual Property Rights, Confidential Information, or prevent misuse of the Platform.

15. CUSTOMER SUPPORT AND GRIEVANCE REDRESSAL

The Grievance Officer shall acknowledge receipt of your complaint within 48 hours and shall endeavour to resolve it within 15 (fifteen) Business Days of receipt.

16. MISCELLANEOUS

  1. Entire Agreement: These Terms, along with the Policies, constitute the entire agreement between you and Highway delite with respect to the use of the Platform and supersede all prior or contemporaneous understandings, agreements, representations, and communications, whether written or oral.
  2. Assignment: You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Highway delite. Highway delite may freely assign, transfer, or subcontract its rights and obligations under these Terms, in whole or in part, without notice or consent.
  3. Waiver: No waiver by Highway delite of any breach or default under these Terms shall be deemed a waiver of any preceding or subsequent breach or default. Any waiver must be in writing and signed by an authorized representative of Highway delite.
  4. Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect and shall be interpreted to give effect to the intent of the Parties to the maximum extent possible.
  5. Force Majeure: Highway delite shall not be liable for any failure or delay in performance caused by a Force Majeure Event, as defined in Clause 1.7, including but not limited to circumstances beyond its reasonable control.
  6. No Agency or Partnership: Nothing in these Terms shall be construed as creating any agency, partnership, joint venture, or other form of joint enterprise, employment, or fiduciary relationship between you and Highway delite. You agree that you do not have any authority to bind Highway delite in any manner.
  7. Survival: All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, provisions relating to Intellectual Property, Indemnity, Limitation of Liability, Dispute Resolution, and Governing Law.
  8. Notices: All notices under these Terms shall be in writing and sent via email or registered post to the contact details provided by the Parties. Notices to Highway delite shall be sent to support@rzervit.com.
  9. Language: These Terms are published in English and shall be the governing version in the event of any discrepancy or conflict with any translated version.
